RopeDocs Terms and Conditions
By accessing or using RopeDocs (“the Application”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions. If you do not agree to these Terms, do not access or use the Application.
Purpose of the Application
RopeDocs is a digital documentation, record management, and workflow platform designed to assist organizations in recording, organizing, storing, and managing workplace safety documentation. RopeDocs is intended solely as an administrative and documentation tool. It does not determine whether work is safe, approve work activities, provide engineering, occupational health and safety, or legal advice, certify regulatory compliance, or replace competent supervision, professional judgment, or the responsibility of qualified personnel to assess and manage workplace hazards. Nothing within RopeDocs shall be interpreted as confirming that work is safe, compliant, approved, or ready to proceed.
User Responsibilities
Users remain solely responsible for ensuring that all information entered into the Application is accurate, complete, current, and truthful, and that all generated forms are reviewed before use. Users are also responsible for identifying workplace hazards, selecting appropriate hazard controls, preparing suitable rescue procedures, ensuring workers are properly trained, competent, and authorized, complying with all applicable legislation, regulations, codes, standards, manufacturer instructions, and company policies, and determining whether work can be performed safely. The use of RopeDocs does not reduce or transfer these responsibilities.
Documentation and Generated Content
Any forms, reports, rescue plans, hazard assessments, suggested hazards, controls, procedures, responses, templates, automated content, or other documentation generated, suggested, or pre-populated by RopeDocs are provided solely as administrative and documentation aids. Such content does not constitute a hazard or risk assessment, safe work procedure, professional advice, or determination that work can be performed safely, and does not replace the independent assessment and judgment of competent personnel. Users remain solely responsible for assessing the actual worksite and conditions, identifying hazards and risks, determining appropriate controls, procedures, and rescue measures, and reviewing and modifying all suggested or generated content as necessary before use. RopeDocs does not represent or warrant that such content is complete, accurate, appropriate for a particular workplace or task, or compliant with applicable laws, regulations, codes, standards, client requirements, or company procedures.
Jurisdictional and Regulatory Requirements
Laws, regulations, codes, standards, client requirements, documentation requirements, record-retention periods, approval processes, and electronic signature requirements vary between jurisdictions, industries, organizations, and projects. RopeDocs is not represented or warranted to satisfy every legal, regulatory, industry, client, or organizational requirement in every jurisdiction in which the Application may be used. Users are solely responsible for determining whether the forms, templates, workflows, records, electronic signatures, and other functionality provided through RopeDocs are appropriate and legally sufficient for their particular jurisdiction, workplace, project, client, and applicable standards or requirements. Where additional or different documentation, approvals, procedures, forms, records, or controls are required, users remain responsible for implementing and maintaining those requirements independently of RopeDocs. Availability of a form, feature, template, or workflow within RopeDocs does not constitute confirmation that it satisfies any particular regulatory, industry, client, or organizational requirement.
Ownership of Data
As between RopeDocs and the customer, all forms, employee records, signatures, reports, photographs, documents, and other customer data entered into or generated through the Application remain the property of the customer. The RopeDocs software, source code, branding, graphics, design, logos, user interface, templates, workflows, and intellectual property remain the exclusive property of RopeDocs and are protected by applicable intellectual property laws.
Acceptable Use
Users must not access accounts without authorization, interfere with the operation of the Application, upload malicious software, introduce viruses or other harmful code, attempt to reverse engineer, copy, or otherwise exploit the software, misuse the platform, submit fraudulent or intentionally false information, or use the Application for any unlawful purpose. Violation of these Terms may result in suspension or termination of access without notice.
Electronic Signatures
Users acknowledge and agree that electronic signatures collected through RopeDocs may constitute valid electronic signatures where recognized by applicable law. Users remain solely responsible for ensuring that any electronic signature collected through the Application satisfies the legal and organizational requirements applicable to their use.
Account Security
Users are responsible for maintaining the confidentiality of their account credentials and for all activity occurring under their account. For security reasons, RopeDocs does not have access to or store users' passwords in readable form and cannot retrieve or disclose them.
Availability of Service
While RopeDocs strives to provide a reliable service, uninterrupted availability of the Application cannot be guaranteed. The Application may occasionally be unavailable due to scheduled maintenance, software updates, technical failures, internet outages, cloud service interruptions, cyber incidents, or other events beyond our reasonable control. RopeDocs shall not be liable for any loss, damage, or inconvenience resulting from such service interruptions.
No Professional Advice
RopeDocs does not provide engineering, occupational health and safety, regulatory, legal, or professional safety advice. Users should consult qualified professionals whenever necessary. Nothing contained within RopeDocs should be relied upon as professional advice.
No Warranty
The Application is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, RopeDocs disclaims all warranties, whether express, implied, statutory, or otherwise, including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, regulatory compliance, uninterrupted service, error-free operation, freedom from defects, and non-infringement. RopeDocs does not warrant that the Application will meet every user's requirements or that any documentation generated through the Application will satisfy the requirements of regulators, inspectors, clients, employers, or any other third party.
Limitation of Liability
To the fullest extent permitted by applicable law, RopeDocs, its owners, officers, directors, employees, contractors, affiliates, licensors, successors, and representatives shall not be liable for any direct, indirect, incidental, consequential, exemplary, punitive, special, or economic damages arising from or relating to the use of, inability to use, or reliance upon the Application or any information or documentation generated through it. This includes, without limitation, damages arising from loss of data, workplace incidents, injuries, fatalities, property damage, equipment damage, environmental damage, regulatory investigations or penalties, business interruption, loss of revenue, loss of profits, or any other loss or damage resulting from the use or misuse of RopeDocs. Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, the foregoing limitations apply only to the maximum extent permitted by law. Where liability cannot legally be excluded, RopeDocs' total aggregate liability shall not exceed the amount paid by the customer for the Application during the twelve (12) months immediately preceding the event giving rise to the claim.
Assumption of Risk
Users acknowledge that workplace activities, particularly those involving construction, rope access, working at heights, confined spaces, industrial operations, and similar activities, carry inherent risks. Users voluntarily assume all risks associated with their use of RopeDocs and acknowledge that safe work remains entirely their responsibility.
Indemnification
Users agree to defend, indemnify, and hold harmless RopeDocs, its owners, employees, officers, contractors, affiliates, licensors, successors, and representatives from and against any claims, actions, lawsuits, investigations, damages, liabilities, penalties, fines, judgments, settlements, costs, and expenses, including reasonable legal fees, arising out of or relating to the use of the Application, workplace incidents, injuries or fatalities, information entered into RopeDocs, documentation generated through the Application, regulatory investigations, violations of applicable laws or regulations, misuse of the Application, or any breach of these Terms.
Privacy
Users are responsible for ensuring that all personal information entered into RopeDocs is collected, stored, and used in accordance with applicable privacy legislation. Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy, which forms part of these Terms.
Suspension or Termination
RopeDocs reserves the right to suspend, restrict, or permanently terminate accounts that violate these Terms or are used in a manner that threatens the security, integrity, or operation of the platform.
Changes to the Service
RopeDocs may update, modify, replace, or discontinue features, functionality, workflows, templates, or services at any time without prior notice. Continued use of the Application constitutes acceptance of such changes.
Changes to These Terms
These Terms & Conditions may be updated from time to time. Continued use of RopeDocs following publication of revised Terms constitutes acceptance of the revised Terms.
Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Nothing in these Terms limits any rights that cannot legally be excluded under applicable law.
Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between RopeDocs and the user regarding use of the Application and supersede all prior discussions, understandings, or agreements relating to the Application.
We may modify these Terms & Conditions from time to time. Continued use of the platform following changes constitutes acceptance of the revised terms.
